Definitions

      • “Seller” means Insulation Crew, its subsidiaries, affiliates, or authorised agents.

      • “Customer” means any individual, agent, or legal entity purchasing insulation installation services from Insulation Crew.

      • “Goods” refers to any insulation products and materials provided by Insulation Crew in connection with installation.

      • “Services” includes all services provided by Insulation Crew, including consultation, installation, and any related advice.

     

    Acceptance of Terms

    By engaging Insulation Crew for insulation installation, the Customer acknowledges and accepts these Terms and Conditions. Only written confirmation from Insulation Crew can modify any representations or warranties not explicitly included in these terms.

     

    Payment Terms

        • Once an installation service is scheduled, the Customer is obligated to pay in full according to these terms, even if the service is later cancelled (except as allowed by law).

        • A 30% deposit is required to secure the Customer’s booking and ensure product availability.

        • Payment is due upon completion of installation, within seven days of the invoice date unless otherwise agreed.

        • Interest of 2.5% per month may be charged on overdue amounts.

        • Any collection or legal costs incurred for non-payment, including debt collection fees, will be payable by the Customer.

        • Accepted payment methods include cash, electronic transfer, or any other mutually agreed method.

      Pricing

      Prices exclude GST and additional costs unless otherwise stated. Installation costs are included in the quoted price unless additional services are specified.

       

      Risk and Ownership

      The goods remain the Seller’s property until payment is made in full. Risk transfers to the Customer upon completion of installation. Insulation Crew reserves the right to retrieve goods if the Customer fails to make full payment.

       

      Limitations of Liability

      Insulation Crew is not liable for any loss of profits, indirect or consequential losses arising from any breach of these terms. In cases where liability is applicable, Insulation Crew’s liability to the Customer will not exceed the total cost of services provided. The Customer is responsible for obtaining any necessary building consents related to insulation installation, although Insulation Crew ensures installations comply with the New Zealand Building Code.

       

      Privacy

      The Customer agrees to Insulation Crew collecting and retaining personal information for credit assessment, contract enforcement, and marketing purposes. Insulation Crew may disclose this information to third parties when necessary for these purposes.

       

      Consumer Guarantees Act 1993

      Goods and services supplied for business purposes are not covered by the Consumer Guarantees Act 1993. Where goods or services are supplied for non-business use, the Act’s protections apply.

       

      Cancellations

      Insulation Crew may cancel a contract or installation service at any time before service provision by giving written notice. Insulation Crew is not liable for any losses resulting from cancellation. If the Customer cancels, Insulation Crew reserves the right to retain any deposits or recover costs incurred.

       

      Warranties

      For materials not manufactured by Insulation Crew, warranties are limited to those provided by the manufacturer. Insulation Crew provides no warranty on second-hand goods, and the Customer must notify Insulation Crew of any workmanship concerns within 24 hours of installation.

       

      Intellectual Property

      All technical data, designs, and materials provided by Insulation Crew remain Insulation Crew’s property. The Customer is liable for any losses arising from unauthorised use of these materials.

       

      Governing Law

      This contract is governed by New Zealand law, and any disputes will be resolved within New Zealand’s jurisdiction.

       

      Updates to Terms

      Insulation Crew reserves the right to update these Terms and Conditions as needed, with written notice to the Customer prior to changes taking effect.
